North Carolina’s misguided Landlord/Tenant Bed bug Liability …
The North Carolina Senate will be considering a bill in 2012 that would have a huge impact on how landlords and tenants deal with bed bugs and who pays for treatment in the state.
H721, also known as the Landlord/Tenant/Bedbug Liability bill, passed in the North Carolina House in June. I have some concerns about its provisions.
The bill would prohibit landlords from renting a unit known to be infested by bed bugs. However, if the landlord gets an inspection from a licensed inspector, prior to leasing the unit, with a written report stating no bed bug evidence was found, then the landlord wont be liable if a problem is discovered later.
If the landlord does not get an inspection before renting the unit, and then a tenant complains bed bugs are present within 60 days of renting the unit, the landlord must hire someone to treat within five days of this complaint. All neighboring units must also be inspected.
Landlords must also provide educational materials about bed bugs to new tenants.
The bill also requires tenants to refrain from knowingly introducing bed bugs to the unit, stating: tenants shall not knowingly or recklessly introduce onto the premises any person or thing infested with bedbugs.
Tenants must notify landlords in writing within five days of suspecting they may have bed bugs.
If the landlord got an inspection before the tenant moved in, or if more than sixty days have passed since the tenant moved in, the tenant must pay all costs of bed bug treatment hiring a firm within seven days.
This tenant would also need to cover any fees charged by the licensee [PCO] and any damages associated with the presence and elimination of bedbugs from the premises and any attached units and spaces.

Adult bed bugs are reddish-brown to all brownish in color. They are oval-shaped, flattened, and about 1/5 inch to 3/16 inch long. Their flat shape enables them to easily hide in small cracks and crevices. The body becomes more swollen, elongated, and dark red after getting a blood meal. Bed bugs have a beaklike piercing-sucking mouthpart system. Newly hatched nymphs are nearly colorless, becoming brownish as they mature. Nymphs have a similar appearance as the adults, eggs are white and around 1/32 inch long. Note: Bed bugs resemble a couple of other closely related insects, such as bat bugs. In Ohio, bat bugs are more common than bed bugs, but in Massachusetts, bed bugs are far more common. Bat bugs prefer bats, but if the preferred host animals are removed and the bat bugs are left untreated, they will seek out a human host. If you visit or live in a building with a bat infestation, this could be a possible source of bites.
Bedbug Life Cycle Eggs adhere to surfaces. Eggs hatch in 6 to 17 days, and the nymphs will immediately begin to feed. They require a blood meal in order to molt and grow. Bed bugs reach maturity after around five molts. Development from (egg to adult) is affected by temperature and takes about 21 days at 86 F to 110 days at 66 F. Bed bugs can go without feeding for 80 to 170 days; older stages can survive longer without feeding than younger ones. Adults have been known to have survived without food for as long as 540 days. A bed bug can consume six times its weight in blood and the feeding process can take 3 to 10 minutes. Adults normally live about 10-15 months and there can be 3 to 4 generations of bed bugs per year.
Bed bugs are fast moving insects. They feed mostly at night when their host is asleep. They use their sharp beak to pierce the skin of a host. Then, they inject a salivary fluid containing an anticoagulant that helps them obtain blood. Nymphs may become engorged with blood within three minutes. A full-grown adult bed bug usually feeds for ten to fifteen minutes. After becoming elongated after a blood meal, they then crawl away to a hiding place to digest the meal. Their sole source of food is the blood meal they take at night, either from humans or bats during the day. Bed bugs hide during the day. They are usually hidden in dark, protected sites. They seem to prefer fabric, wood, and paper surfaces. They are usually in close proximity to the host, although they can quickly travel far distances. Bed bugs initially can be found about in tufts, seams, and folds of the mattresses, later spreading to crevices in the bed frame and in the box-spring. In heavier infestations, they will occupy hiding places farther from the bed. They may hide in window or doorframes, floor cracks, baseboards, furniture, electrical boxes, and under the tack board of wall-to-wall carpeting. Bed bugs also often crawl upward to hide in pictures, wall hangings, loosened wallpaper, cracks in plaster, drapery pleats, and ceiling moldings.

Just curious --- having been a victim of bedbugs in Baltimore two years ago --- I'm wondering (redsox53) if there is a specific reason why you are asking?
I think jwhiteree gave really good advice. In my case, it was at a BWI hotel in 10/08 (where I'd stayed several times before) and it ruined my week-long vacation. The hotel was moving me all over the place (room-to-room) and saying things like....*oh, that's just fuzz.* Not when I was getting bitten, it wasn't. I proved it to them with a roll of scotch tape --- taping the larva to a pillow case. I never saw an adult bedbug. They comp'd me all my meals for a week, without ever admitting they had a problem. They said nobody else had complained. I would have left the hotel completely but paid via Hotwire and couldn't afford a different hotel. Plus there was a bedbug problem in a local college then so I figured (if I left) I might just get stuck in another hotel with the same problem.
The good news is --- they were in the process of a complete renovation already so they also threw away all their mattresses, lines, bed coverings, towels, etc. The WHOLE hotel. Plus, as part of the renovation, they replaced their flooring.
Knowing they were renovating and they *appeared* to be doing something about it, I agreed to stay there again in 04/09. When I walked in, everyone recognized me from 6 months earlier. That blows my mind as I could not POSSIBLY have been the only person to complain but the stink I made, with visits to the desk (thus it was embarrassing to them while other guests were there), was evidently memorable.
Bottom-line. There were ZERO problems the next time. No bedbugs and the entire staff was very nice to me. They didn't admit the problem the previous visit but they too seemed relieved to be rid of it. It was the Holiday Inn BWI, BTW, and the issue had been solved last year.
I realize there is a problem in certain areas but as some indicate, there are things you can do to prevent the spread. I always avoid putting luggage on the bed but I like jwhite's suggestion of putting it in the bathtub (or at least the bathroom). I've stayed in 3 different hotels in the area since and no problem.
Are you concerned about reports in the area (?) or did someone tell you something about that specific hotel? You say you called the hotel but did you also e-mail them (for a record) and tell them why you are concerned?
Good luck. It's not fun so, like you, I tend to be very diligent on this issue in that area. Actually, any area lately which tends to be humid.
