Can I Sue My Landlord for Bed Bugs in the Building? – Nolo

In all states but Arkansas, landlord are required to provide tenants a safe and livable home, under whats known as the implied warranty of habitability. This includes exterminating infestations of rodents and other vermin that endanger a tenants health or safety. A widespread bed bug infestation would qualify as a habitability problem, and some states have specific laws on landlord responsibility for bed bug eradication. If your landlord is responsible for cleaning up a bed bug infestation (see Landlord Responsibility for Bed Bugs), but refuses to do so (by hiring an exterminator, for example), you may, depending on where you live, have several options. These include withholding rent, paying for the extermination and deducting the costs from your rent, and moving out without future liability for rent. We emphasize the word may have these options, because it depends not only on your state laws on rent withholding and other tenant protections, but the details of the specific bed bug problem. The more the landlord can demonstrate that he or she took steps to immediately and effectively try to eliminate the bed bugs, the weaker your case.

Depending on the specifics of your case, you may also have grounds for suing your landlord for failure to provide habitable premises by eradicating the bed bugs. You can probably use small claims court, which allows claims of up to several thousand dollars, to sue your landlord for bed bugs. Its relatively inexpensive to sue in small claims court, you dont need a lawyer (in fact, some states dont allow lawyers in small claims court), and disputes usually go before a judge within a month or so. Before filing a small claims lawsuit, be sure to send your landlord a written demand letter (this is required in some states as a condition of filing a small claims lawsuit) that explains your legal rights and what you want from the landlord. Also, take your time preparing evidence, including photos of the bed bug problems, your complaint letters to your landlord or manager, reports of and receipts from any exterminators you hired, and statements from other tenants in the building.

Whether you use small claims court or sue the landlord in another court, you may want to consult with an attorney. How to avoid getting bedbugs this moving season – CBC.ca

Moving season means garage sales, free furniture on the curb, rented moving vans and increased anxiety that bed bugs might take advantage of any of these things to work their way into new homes.

After two years of stability, there's an increase in bed bugs in Montreal, according to Mathieu Vachon, a spokesperson for Montreal's Public Housing Authority.

"It's still a very big problem in Montreal," he said.

Bed bugs are rarely seen but are recognizable because they look slightly like apple seeds and are flatif they haven't eaten, or plump and red if they have snacked on someone's blood recently.

Look for them in bed frames, mattresses, drapes, floorboards, carpets, book bindings, electrical outletsbasically anywhere that isn't pure plastic.

Pest specialists stress prevention and a quick responseif a person spots anysigns that a home has some tiny, hostile visitors.

Vachon said that calling a professional is the best solution for anyone facing an infestation treating it oneself with a store bought item is a bad idea.

"First off they're useless," Vachon said.

"They only push away the bugs. So if you're in an apartment building, they may just push them to your neighbours."

Never pick up furniture on the curb. Mattresses, lamps, drawers, chairs, sofas, you name it, it could be infested.

Vachon said a good neighbour should visiblydamage items that are infested to make it clear that are not to be taken.

Be careful when shopping at garage sales as well and inspect items before buying.

Moving vans and the reused blankets that movers put on items can have bed bugs in them.

Put fabric items in tightly closed plastic bags and seal boxes with tape, making sure all opening are blocked.

Also, cover mattresses and furniture with big plastic bags that can be tightly sealed off.

Make sure your movers are aware of the bed bug problem and are working to ensure their service isn't spreading the pest.

"The person who has bed bugs will infest the truck and all the people who move that day," pest control specialist HaroldLeaveysaid.

Inspect a rented van before putting items in it.

Vacuum the inside and throw the bag out in a bin outside your home immediately afterward.

Inspect your new space before moving furniture in. It's easier to check for bed bugs with a flashlight when there aren't any items in the way.

Vachon said its best to pay particular attention to the bedroom bed bugs rarely move beyond it unless there are so many that thereisn't enough room for all of them in there.

Bed bugs can hide in electrical sockets, mouldings, behind radiators and even in cracks in the walls.

Leavey said it's important not to stop living out of fear of a bed bug infestation.

He said that some of his clients have told him they're so scared of getting bed bugs that they avoid going to the movies worried one will crawl onto them from the seat cushions.

"You can't let it get that bad. At that point,bed bugs aren't burrowing into our mattress, they're in our head," Leavey said.

"Dragnet" to kill bed bugs. PEST CONTROL CANADA

Our neighbors have admitted to having bed bugs and told our landlord they took care of it NOW COUPLE MONTHS LATER we found a couple on one of our beds! Please know me or my husband have NEVER had bed bugs before we told our landlord and she is getting a pest control company to come treat both places and they are using Dragnet i was wondering can this being in our place pose a risk to my 5 year old!
