The horror stories about bed bug infestations continue to multiply. Now we have improved guidance for addressing this problem, which has cost properties hundreds of thousands of dollars. Can I Sue My Landlord for Bed Bugs in the Building? – Nolo

In all states but Arkansas, landlord are required to provide tenants a safe and livable home, under whats known as the implied warranty of habitability. This includes exterminating infestations of rodents and other vermin that endanger a tenants health or safety. A widespread bed bug infestation would qualify as a habitability problem, and some states have specific laws on landlord responsibility for bed bug eradication. See the National Conference of State Legislatures compilation of state bed bug laws for details on your state.

If your landlord is responsible for cleaning up a bed bug infestation (see Landlord Responsibility for Bed Bugs), but refuses to do so (by hiring an exterminator, for example), you may, depending on where you live, have several options. These include withholding rent, paying for the extermination and deducting the costs from your rent, and moving out without future liability for rent. We emphasize the word may have these options, because it depends not only on your state laws on rent withholding and other tenant protections, but the details of the specific bed bug problem. The more the landlord can demonstrate that he or she took steps to immediately and effectively try to eliminate the bed bugs, the weaker your case.

Depending on the specifics of your case, you may also have grounds for suing your landlord for failure to provide habitable premises by eradicating the bed bugs. You can probably use small claims court, which allows claims of up to several thousand dollars, to sue your landlord for bed bugs. Its relatively inexpensive to sue in small claims court, you dont need a lawyer (in fact, some states dont allow lawyers in small claims court), and disputes usually go before a judge within a month or so. Before filing a small claims lawsuit, be sure to send your landlord a written demand letter (this is required in some states as a condition of filing a small claims lawsuit) that explains your legal rights and what you want from the landlord. Also, take your time preparing evidence, including photos of the bed bug problems, your complaint letters to your landlord or manager, reports of and receipts from any exterminators you hired, and statements from other tenants in the building.

Whether you use small claims court or sue the landlord in another court, you may want to consult with an attorney. If there is an attorney fees clause in your lease or rental agreement, you may be entitled to reimbursement for your attorney fees and court costs if you win your lawsuit against your landlord; this assumes that your dispute arises out of your lease or rental agreementfor example, if your landlord fails to comply with repair and maintenance rules specified in your lease or rental agreement.

BED BUGS Bed Bugsare the little creatures that may come out at night and invade your bed or furniture like couches or mattresses. They seem to prefer human and other warm blooded creatures. Bed bug infestations were common in the United States before World War II. But with improvements in hygiene, and widespread use of DDT until it was banned, the bugs nearly vanished. However, they remained active outside the US.

HOW BED BUGS OPERATE

1. We travel out of the country and the bed bugs latch on to you, your clothing and things you pack in your luggage for the trip back to the US. 2. We have visitors and new residents coming to the US each day from foreign countries. 3. When we travel we stay in hotels or other accommodations that may have a bed bug problem(s). In Multi-family housing units, it is believed the bed bug can travel through duct work, cracks between units (they dont have to be big)- tenants furniture being moved in and out allows simple transfer around the building.

Its possible for one of you to be bitten and another resident in your home not.

In most Bed Bug laws enacted or in to be enacted, Bedbug means an insect of the species Cimex lectularius, commonly referred to as a bedbug

WHAT DO THEY LOOK LIKE

Adult bedbugs are reddish-brown, with a flat oval shape, and wingless, with microscopic hairs. They dont move fast, so you should be able to spot them. Bed Bugs CANNOT FLY. Bedbugs can live for a year or longer without feeding but they normally try to feed every five to ten days. Bedbugs that go dormant for lack of food often live longer than a year, while well-fed specimens typically live six to nine months. Bedbugs will appear at night, when they need to eat (your blood) and sense the hear given off by your body. KEEP CLEAN and CLUTTER FREE Vacuum Furniture walls, wall paper, cracks in floors and near beds bed frame, box spring etc. CLEAN. Keep clean. Vacuum often and empty out the canister or bag. Wipe down walls and wash your linens. bed sheets, shams etc. Try not to have much clutter. HOWEVER, REGARDLESS of how clean you are, you may still wind up with a bed bug problem TENANTS, LANDLORDS, AND BED BUGS THE LAW In 2004, a Bedford New York Judge made the following remark in a Bed Bug Lawsuit Although bedbug are classified as vermin, they are unlike the more common situation of vermin such as mice and roaches, which, although offensive, do not have the effect on ones life as bedbugs do, feeding upon ones blood in hoards [sic] nightly turning what is supposed to be bed rest or sleep into a hellish experience, Judge Bedford wrote. InNew York Cityand many other states, towns and cities, landlords are now responsible for getting rid of bed bugs in infested buildings and units and they must pay for extermination.

Lots of requirements for both landlords to notify tenants and tenants to notify the landlord. Since Im a NJ landlord, Im still trying to figure it out. The state holds landlords responsible for extermination in multi-unit buildings of three or more apartments if the bugs are found in two or more units or in common areas.. BED BUGS and LAWYERS My friend, a landlord, is convinced that a layer was the first to bring bed bugs back to the US and deploy them. WHY? It was and is another line of business. Landlords might think they can use (blame) a a particular tenant for infesting their building, apartment or home with the bug while a tenant may blame a landlord for allowing (by not regularly exterminating for) the bug or allowing tenants who the landlord should of know have or might have the bug or not informing the tenant that there was, could be or was unsure if there is, was, was not, what if. a bed bug problem.Find a Lawyer What came first the chicken or the egg? Is the glass half full or half empty.what came first the tenant or the bed bug? Whose Bed Bug is it? Exterminator If you choose to, you may call an exterminator who will most likely come back every month to spray. Your landlord MAY NOT BE RESPONSIBLE for the problem, unless local or state law state otherwise.

State officials will address bed bug issue Monday before Craven commissioners – New Bern Sun Journal

The state Division of Health Service Regulation remains mum on specifics about public reports of bed bugs in local adult long-term care facilities.

The division, which is under the North Carolina Department of Health and Human Services, did not provide any specifics following written and telephone requests by the Sun Journal.

Two state section chiefs are scheduled to talk with the Craven County commissioners at their 8:30 a.m. Monday meeting.

Adult Care Home Licensure Section Chief Megan Lamphere and Construction Section Chief Steve Lewis are slated to talk to the commissioners.

Requests for an interview with Lamphere resulted in an email from the communications department, outlining general bed bug issues that would be discussed.

A follow-up Sun Journal request for information related to Craven County did not get a response.

The commissioners first heard about the bed bug reports in several local facilities during the volunteer Craven County Adult Care Advisory Committee report late last month.

Commissioners questioned what was and could be done, with some reports from the committee noting bed bugs in facilities over several years.

County Manager Jack Veit sent a letter to Lamphere requesting she come before the board.

In another major Monday agenda item, the commissioners are expected to officially pass the 2017-18 budget.

The $107 million spending plan has had no major opposition since it was presented about a month ago, including a public hearing.

It maintains property taxes at the current level, $53.94 and includes no new service fees and no use of county savings to balance the plan.

The commissioners also have a work session planned after the morning meeting, which includes addressing a long-standing issue of canine tethering, which has been brought up by an animal rights group several times.

A commissioners committee has studied the matter for several months and could offer changes to the current animal ordinance, which does not address tethering times or rules.

If the board decides to make changes or additions, a public hearing will be scheduled for a future meeting before a final vote can be taken.

Mother says motel refuses to take responsibility for bedbugs – WSB Atlanta

UNION CITY, Ga. - A Union City mother told Channel 2 Action News that she came home to find her daughter covered in bedbugs.

The family lives at an extended stay motel and Schlendia Robinson told Channel 2s Nicole Carr she cant afford to move.

A manager at the motel told Carr he's aware of this case but believes the woman or her guests may have brought the critters in.

Robinson and other residents saidthey're being blamed for a mattress issue that existed before they checked in.

If I could stay somewhere else I would. I don't want to be here, Robinson told Carr.

Robinson moved her five children into the Union City Extended Stay motel last month after the familylost its home due to financial issues.

I work two full-time jobs to be able to stay here, Robinson said.

When she saw the marks all over her 3-year-old daughter, she thought they may have come from playing outside.

Last week, Robinson said, when she pulled the covers and mattress pads back on her daughters bed, she found the bugs.

And that's when they were out all over my daughter's face," Robinson told Carr.

The Robinsons and other residents told Carr they've been transferred to other rooms.

Carr found several old mattresses being aired out but the hotel management is refusing to take responsibility for the bugs.

Did they suggest that you all brought them as well? Carr asked another resident.

Oh yes! I was informed that I brought them in, but I said, 'Wait a minute. I'm too clean-natured. I don't do bugs, so why would you say that?" the resident told Carr.

Carr spoke with a manager who wouldn't rule out the possibility of the guests bringing the bugs in.

He said legitimate complaints get residents moved to new rooms while they perform pest control, but there's no offer of reimbursement and he said he's unaware of past outbreaks.

Residents have forwarded complaints to the Fulton County Health Department, but records were not immediately available.

People who say they don't have many residential optionsare now looking for a quicksolution to the bedbug problem.

My daughter is swollen. She's been scratching. She hasn't been able to sleep comfortable. I need to understand what's happening. How could you guys allow this to happen? Robinson said.
