Bed Bugs in New Hampshire & The Law

Bed Bug Law HB 482, effective January 1, 2014. Summary: HB 482 will be effective Jan. 1, 2014. It clarifies landlord and tenant responsibilities during a bed bug infestation in rental property.

After report in tenants unit: Once a landlord becomes aware of a bed bug complaint in a tenants unit, he/she is allowed emergency entry into that unit for the next 72 hours . After report in adjacent unit: If there is a bed bug complaint from an adjacent unit, a landlord is allowed emergency entry into tenants unit. The landlord must give the tenant 48 hours notice. It is a violation for a tenant to willfully refuse emergency entry (contempt and contempt damages).

A landlord must provide the tenant with reasonable written instructions for preparing the unit for remediation. These instructions must be given to an adult 72 hours in advance of remediation. It is a violation for tenants to willfully refuse to comply with these instructions. Landlords can evict for failure of tenant to prepare the unit with advance reasonable written notice. However, landlords must allow for reasonable accommodation requests related to preparing the unit.

Landlords are required to pay up-front for all bed bug remediation costs. Landlords may recover costs for remediation in the tenants unit only, and only if tenant is considered responsible for the infestation. The tenant is presumed to be responsible if only his/her unit has bed bugs and there have no other bed bug reports in the unit or adjacent units in previous six (6) months. Landlords can evict responsible tenants for nonpayment, provided the landlord shows that he/she offered tenant a reasonable repayment agreement.

Bed Bugs on the Rise

Bed bugs are on the rise in Illinois after a dramatic decline in the 1940s and 1950s. A couple reasons for the return are more world-wide travel and the fact that todays insecticides, although safer for people, are less effective in killing these bugs. Bed bugs are small, flat insects, usually reddish-brown and up to -inch long. Bed bugs most commonly enter hotels or residences by hitch-hiking on a suitcase or backpack, used furniture and clothing or other objects moved from one building to another. Although bed bugs are not known to transmit disease, their bites can cause an intense itch and scratching could produce secondary infections. To help reduce this problem, learn the signs of bed bug infestations, how the bugs spread, what you can do to prevent getting them and what to do if you find bed bugs.

Bed bugs still an issue at Northwest Georgia Housing …

A bed bug infestation at the Northwest Georgia Housing Authority senior high-rise apartments in Rome is still causing problems for a handful of tenants.

Executive Director Sandra Hudson said Wednesday she has two tenants still housed in local motels and two more who are going to be displaced while their apartments are being treated.

Since the bugs were reported in a dozen units last month, the NWGHA has spent $49,000 to treat for the critters and pay for temporary housing and meals for displaced families.

The board of directors approved a policy revision Wednesday that spells out the responsibility of both tenants and the authority when bed bugs are discovered. It requires tenants to be proactive by avoiding clutter in their apartments and checking baggage and clothing after all trips.

If bed bugs are discovered in an apartment, the inspection will extend to units on either side of it as well as above and below.

Residents wont be charged for treatment unless they were to lose or damage materials supplied to deal with the infestation.

If they are uncooperative or reckless, they could be subject to having their lease terminated, NWGHA Attorney Stewart Duggan said.

In other business, Technical Services Director Doug Braden briefed the board on efforts to deal with the hundreds of false fire alarms at the high-rise apartments that are generally the result of overcooked food.

Each unit has a smoke detector in the kitchen and one in the den. The fire department gets an average of 25 false alarms each month.

Braden said theyre working with its alarm company, Tyco SimplexGrinnell, to re-program the smoke detectors. Tenants would get 45 seconds to a minute to clear the smoke after the first alarm before a second alarm and call to the fire department is triggered.

California fights bed bugs: good news from the golden …

Some exciting things are happening in California, and have been for some time. Since weve been giving a lot of love to Cincinnati lately, I wanted to fill you in on the California scene.

First, Bedbuggers should know have a friend in California: Dr. Laura Krueger. Shes the Associate Public Health Biologist in the Vector-Borne Disease Section of the California Dept. of Public Health. Laura has commented here a number of times, and has been reading the site for a while. She co-wrote the Guidelines for the Control and Prevention of Bed Bug Infestations in California (February 2007) (click here for a PDF). The California Bed Bug Guidelines were based, in turn, on other similar documents. A footnote tells us: CDHS adapted these guidelines for bed bug control from the San Francisco Department of Public Health and the Australian Environmental Pest Managers Association. (Click here for a PDF of the 2nd edition of the Australian Guidelines (June 2007; California based their guidelines on the first edition); the San Francisco Guidelines link is currently down.

The California Bed Bug Guidelines are just that: suggestions, a good plan, for how PCOs, and owners of hotels and multi-unit dwellings should work to prevent and control bed bugs. The Guidelines are not enforceable in and of themselves.

As an example, the Guidelines suggest that PCOs should come a minimum of three times, spaced two weeks apart; that hotel or apartment managers should respond to complaints of bed bugs within 48 hours with a plan of action (and that the plan of action should be executed within 72 hours of the complaint being made); and that tenants should should not remove anything from the infested room until the PCO comes and directs them.

I would argue that some aspects of the guidelines need to be revised. For example, one guideline states that tenants should report bed bugs to the owner or operator within 24 hours of the pest sighting. This seems like good advice, but many people are bitten by bed bugs for a long time without actually seeing a pest. PCOs and other professionals are still learning how very stealthy bed bugs can be.

Nevertheless, the Guidelines are impressive and I am grateful that the California Department of Health Services has compiled them.

There have also been some recent positive developments in California in terms of government funding to help those with bed bugs fight the problem. In San Francisco, as the second item down on this page of the Central City SRO Collaborative (CCSRO) website states,

The Central City SRO Collaborative organized with tenants and other community groups to demand funding for subsidies for low-income tenants. At the urging of this activist group, [City of San Francisco] Supervisor Chris Daly got $63,000 in this years budget for subsidized laundry and freezing services for low-income tenants with bedbug infestations, a huge public education campaign for tenants and landlords, and 2 annual forumsone for landlords/tenants and one for social service workers/tenantsthat will teach public health code, bedbug cleanup, and tenant advocacy.

Lets pause a moment and reflect on the historical context of this: the hearing happened three months before NYC held its city council hearing on the resale of mattresses (one which has not yet borne fruit), and a good 16 months before Cincinnatis recent fabled town hall meeting on bed bugs.
