New Hampshire Passes Landlord Bed Bug Law By Chris Williams on September 5, 2013.

As a result of legislation passed in June, New Hampshire residents who live in rental housing will soon have some direction and some recourse when it comes to living with bed bugs.

The new law takes effect January 1, 2014 and addresses the ongoing debate of who pays for bed bug treatment in a rental apartment. Presently, there is no specific law and no guidelines as to who is responsible when a bed bug infestation occurs. Landlords say that the tenants brought the bed bugs into the apartment, so they should pay for treatment. Tenants say they moved into an apartment that already had bed bugs, or the bed bugs came from next door, and the landlord has to fix the problem. They argue that their rental agreement provides for pest control and entitles them to a habitable dwelling. Landlords balk at having to provide control for bed bugs because bed bug control is more complicated and more expensive than control for other standard apartment pests. While the two sides argue, bed bugs move into other units in the building and soon, everyone has a problem.

The new law makes it clear that the landlord is responsible for resolving a bed bug problem, no matter who is responsible for causing it. Landlords will have a 7-day window to investigate a bed bug complaint and take reasonable measures to remediate the infestation. If landlords fail to address the situation, tenants can file court action to force their landlord to act. The landlord must pay for bed bug treatment, but the new law gives the landlord the right to bill the tenant for his costs if it is determined that the tenant is ultimately the one responsible for the infestation.

Seems like that takes us right back to square onehe said, she said. However, if the parties involved dont agree on responsibility, a court will decide by looking at which units first had bed bugs, whether bed bugs are in other areas of the building, whether the landlord attempted any control prior, and whether the tenant had bed bugs in their previous home, among other things.

For their part, tenants must allow landlords into their apartments to evaluate, inspect, and treat for bed bugs. They must follow instructions to prepare their apartment for treatment. If the bed bugs are deemed to be their responsibility, they must pay for the remediation. Failure to do any of these things can result in eviction.

The new law is not a perfect solution but it is a compromise agreed upon by a working group made up of landlords and tenants. The new law avoids the situation where the landlord is always the one paying for treatment, while assuring that treatment gets done before bed bugs spread throughout a building.

Know Where Bed Bugs Hide – BadBedBugs.com

As most of you know bed bugs were once on the down low but have now returned with vengeance or as some may say a bed bug epidemic is on the rise. With this ever growing problem it is key to learn what a bed bug is, where they hide and how to get ride of them and keep them gone for good.

To start with, Ive listed all the places on my bed bug checklist and if you find them, then read my page on how to use bed bug dust to exterminate them yourself.

Susan Smith-Durisek wrote a great and informative article for Kentucky Living. In her article she highlights many ways to minimize your contact with unwanted critters bed bugs. The main points that she covers include inspecting your mattress in a hotel room before settling in.

What should you look for? Rusty spots or actual bugs along the mattress seams and headboard. Also, one of the most important things to remember is never, ever pick up discarded furniture on the side of the road. You never know if there are bed bugs lurking in that free recliner chair and its wise to know this is one of the most common ways to pick up bed bugs and cause an infestation in your own home.

City of Chicago :: Bed Bugs

Bed bugs are small, flat, wingless insects. They feed on blood and can be a nuisance for individuals. They are named for their tendency to live on mattresses or other parts of a bed. They can be found in homes, condominiums, apartments, hotels, schools, dormitories, shelters, offices and many other places. For more information on bed bugs, click here.

In 2013, the City Council passed an ordinance to help address the problem of bed bugs. That ordinance is available here. The requirements established by this ordinance follow:

Rental Housing

The ordinance established several requirements for both landlords and tenants. Among these is a requirement that landlords must provide a brochure on bed bugs to tenants when signing a new or renewing an existing lease or other rental agreeement (note this requirement does not apply to owner-occupied buildings containing six units or less). The brochure,available in English, Spanish, Polish and Chinese, is available here. The brochure lists all of the requirements of the ordinance for both landlords and tenants.

Condominium and Cooperative Buildings

All governing associations need to have a written plan to address bed bugs. A sample plan was created to assist associations in developing their plans. That sample plan is available here and lists all of the requirements of the ordinance for those who own units within condominium or cooperative buildings. The sample plan also refers to a fact sheet that can be provided to unit owners. That fact sheet is available here.

How to Detect Bedbugs – Bed Bug Detection

Detecting bed bugs can be difficult, as they are small in size and able to hide in tiny cracks and crevices. However, evidence of a bed bug infestation may be found in bedding and on mattresses. Live bed bugs leave clusters of dark brown or black spots of dried excrement on infested surfaces. Bed bugs also exude a subtle, sweet, musty odor.

Bed bugs usually are found close to where people spend much of their time, and since bed bugs have flattened bodies, they like to get into small cracks and crevice near where people sleep. Examples include mattresses, box springs, headboards, footboards, bed frames and other furniture that is within 5-8 feet of the bed. Other common locations are cracks and gaps behind wall outlets, floor molding, window and door molding and where carpet edges meet the wall. Bed bugs have been known to occur in many different locations if their population is large and they have dispersed from their more common areas to areas where they are normally less likely to be found.

Bed bugs are easily transported into previously non-infested dwellings.
